TERMS OF SERVICE

Artist: Yunero
By commissioning me (Yunero), you agree to the following terms.
Please read them carefully before placing an order.

1. General- These Terms of Service may be updated at any time. You are bound by the version in effect at the time your commission is accepted.
- I reserve the right to accept or decline any commission request that is mentioned in section 5.
- All commissions are for personal use only unless a separate commercial license is explicitly purchased and agreed upon in writing.2. Ordering Process- Contact me through my preferred platform (Artistree / Discord / Email / Instagram / Ko-fi) with your commission request.
- Provide as much detail as possible, including:
•••Clear character references (images, mood boards, color palettes, etc.)
•••Detailed description of the desired scene, pose, expression, outfit, and composition
•••Any specific requests (background, style preferences, size, etc.)
-I will review your request and reply with:
•••Confirmation of whether I accept the commission
•••Final price quote
•••Estimated timeline
•••Any additional questions or suggestions
- Once we have agreed on all details, I will need a 50% deposit to proceed.
Work will begin only after the deposit is paid and all references are finalized and approved.3. Payment- Payment is accepted via PayPal, Stripe, Artistree, Ko-fi or other agreed methods, in USD.
- Prices are final once the commission is accepted.
- 50% upfront after brief approval - 20% for sketch approval - 30% for final product.
- Full payment is due before delivery of the final files.4. Process & Revisions- You will receive a sketch or thumbnails for approval.
- Minor revisions (small adjustments to pose, expression, colors, or details) are included during the sketch and coloring stages.
- Major changes (significant redesigns, new poses, outfit changes, etc.) after sketch approval will incur additional fees. (5 USD)
- I will send progress updates at key stages. If I receive no response within 48–72 hours, it will be considered approval to proceed.
- Estimated completion time is usually 1–3 weeks depending on complexity and my current workload. I will communicate any delays promptly.5. What I Will Not DrawI will not accept commissions involving:
- Gore or torture
- Hate symbols or propaganda
- Underage / minor characters in sexual or suggestive contexts
- Complicated mecha / heavy machinery (subject to discussion)
- Any content that violates my personal boundaries or platform rules6. Copyright & Usage Rights- I (Yunero) retain full copyright of the artwork at all times.
- By default, all commissions are for personal use only.Personal Use License (Standard Commission)
You are granted a personal, non-transferable, non-exclusive, non-commercial license to use the artwork for personal display and enjoyment, including:
- Social media posts and profile pictures
- Personal prints and wallpapers
- Personal portfolios or fan content (non-monetized)
- All commissions are for personal use only unless a separate Commercial License is explicitly purchased and agreed upon in writing. Commercial rates and terms will be discussed and quoted separately.
You may not:
- Claim the artwork as your own creation
- Sell, resell, reproduce, or distribute the artwork
- Use it for any commercial purpose (merchandise, advertising, business branding, monetized content, etc.)
- Edit, trace, heavily modify, or use the artwork as a base for new commercial works without permission
- Feed the artwork into any AI training datasets or generative toolsCommercial Use License (Separate Purchase Required)
If you explicitly purchase a Commercial License (which must be agreed upon in writing before or at the time of commissioning), you will receive expanded rights in addition to the personal use rights above.
Commercial rights include:
- Use of the artwork for commercial projects such as merchandise (prints, apparel, stickers, etc.), book illustrations, advertising, branding, monetized content (YouTube, Twitch, etc.), and other profit-generating purposes.
- The right to reproduce and sell physical and digital products featuring the artwork (subject to any limitations agreed upon in writing).
Commercial License Limitations:
- The license is non-exclusive and non-transferable unless otherwise agreed in writing.
- You may not claim copyright ownership or exclusive rights to the artwork.
- You must give proper credit to me (Yunero) whenever the artwork is used publicly (e.g. “Art by Yunero”).
- The commercial license does not allow you to resell the raw artwork files themselves or sublicense the artwork to third parties without my written permission.
- AI training or use in generative AI tools remains prohibited.I may showcase the finished artwork in my portfolio and on social media unless you specifically request it to be kept private (this request must be made at the time of commissioning). Private commissions will still be counted toward my portfolio anonymously if desired.7. Delivery- Final files will be delivered as high-resolution PNG, JPG (or PSD/SAI upon a certain price - 80% total price).
- Delivery will be made via email, Discord, or any social messaging.8. Cancellations & Refunds
(Important note: I also work as an Interior Design so I usually do the background first)The artist:
90-100% refund if myself want to cancel the commission.
The client:
- Before work begins: Full refund (minus any transaction fees).
- After sketch/thumbnail approval: 100% refund possible.
- After flat background + flat color: 50% refunds.
- After detailed background or detail main subjects: 30% refunds.
- After all mentioned above: No refunds.9. Liability- I am not responsible for any misuse of the artwork by the client.
- My liability is limited to the total amount paid for the commission.10. Communication & Conduct
Primary communication channels: Artistree / Discord / Email / Ko-fi (please stick to one main platform).
Please remain respectful and patient. I will do the same.
Harassing, rude, or excessively demanding behavior will result in immediate cancellation of the commission without refund.

- Sau khi thống nhất tất cả chi tiết, cần đặt cọc 50% để bắt đầu.
- Công việc chỉ bắt đầu sau khi nhận cọc và tất cả tài liệu tham khảo đã được duyệt cuối cùng.
3. Payment-Chấp nhận thanh toán qua ngân hàng, MOMO, ZaloPay… hoặc các phương thức khác đã thỏa thuận.
- Giá đã chốt khi commission được chấp nhận.
- Cọc 50% sau khi chốt brief - Thanh toán 20% sau duyệt sketch - 30% cho sản phẩm cuối cùng.
- Thanh toán đầy đủ trước khi nhận file hoàn thiện.4. Process & Revisions- Bạn sẽ nhận được sketch hoặc thumbnail để duyệt.
- Thay đổi nhỏ (chỉnh tư thế, biểu cảm, màu sắc, chi tiết nhỏ) được bao gồm trong giai đoạn sketch và tô màu.
- Thay đổi lớn (thay đổi tư thế, trang phục, thiết kế lại đáng kể...) sau khi duyệt sketch sẽ tính phí thêm 50.000-100.000 VNĐ.
Tôi sẽ gửi tiến độ ở các giai đoạn quan trọng. Nếu không nhận được phản hồi trong vòng 48–72 giờ, coi như bạn đã đồng ý để tôi tiếp tục.
Thời gian hoàn thành thường từ 1–3 tuần, tùy độ phức tạp và lịch làm việc hiện tại. Tôi sẽ thông báo kịp thời nếu có trì hoãn.5. What I Will Not DrawTôi không nhận commission liên quan đến:
- Gore hoặc tra tấn
- Biểu tượng thù địch hoặc tuyên truyền xấu
- Nhân vật vị thành niên / trẻ em trong ngữ cảnh tình dục hoặc gợi cảm
- Mecha / máy móc phức tạp nặng (có thể thương lượng)
- Bất kỳ nội dung nào vi phạm nguyên tắc cá nhân hoặc quy định nền tảng của tôi6. Copyright & Usage Rights- Tôi (Yunero) giữ toàn quyền bản quyền của tác phẩm ở mọi thời điểm.
- Mặc định, tất cả commission chỉ dành cho **mục đích sử dụng cá nhân.Sản phẩm Cá nhân (Commission Thường)
Bạn sẽ nhận sản phẩm của bạn, không chuyển nhượng, không độc quyền, không thương mại để sử dụng tác phẩm cho mục đích cá nhân như:
- Đăng mạng xã hội và ảnh đại diện
- In ấn cá nhân và hình nền
Portfolio cá nhân hoặc fan content (không kiếm tiền)
Bạn không được:
- Tuyên bố tác phẩm là sáng tạo của mình
- Bán, tái bán, sao chép hoặc phân phối tác phẩm
- Sử dụng cho mục đích thương mại (hàng hóa, quảng cáo, branding, nội dung kiếm tiền...)
- Chỉnh sửa, trace, sửa chữa hoặc dùng làm base cho tác phẩm mới mà không có sự cho phép
- Đưa tác phẩm vào bộ dữ liệu huấn luyện AI hoặc công cụ tái tạo hình ảnh.Sản phẩm Thương mại (Commercial License - Trao đổi riêng)
Nếu chúng ta thỏa thuận sản phẩm thương mại (phải thỏa thuận bằng văn bản trước hoặc khi commission), bạn sẽ được quyền sử dụng mở rộng hơn.
Quyền thương mại bao gồm:
- Sử dụng cho hàng hóa (in ấn, áo thun, sticker...), sách, quảng cáo, branding, nội dung kiếm tiền (YouTube, Twitch, TikTok...), v.v.
- Quyền sao chép và bán sản phẩm vật lý lẫn kỹ thuật số có chứa tác phẩm (theo thỏa thuận)
Giới hạn của sản phẩm Thương mại:
- Giấy phép không độc quyền và không chuyển nhượng trừ khi có thỏa thuận khác bằng văn bản.
- Bạn phải ghi credit công khai: “Art by Yunero”
- Không được bán file gốc hoặc chuyển nhượng cho bên thứ ba
- Vẫn cấm sử dụng AI
Tôi có quyền đăng tác phẩm lên portfolio và mạng xã hội trừ khi bạn yêu cầu giữ riêng tư (yêu cầu phải đưa ra lúc commission).7. Sản phẩm cuối
File hoàn thiện sẽ được giao dưới dạng PNG, JPG chất lượng cao (hoặc PSD/SAI với giá 80% tổng giá trị commission).
Giao qua email, Discord hoặc tin nhắn mạng xã hội.8. Hoàn TiềnPhía Artist:
Hoàn tiền 90–100% nếu tôi tự hủy commission.
Phía Client:
Trước khi bắt đầu làm: Hoàn tiền toàn bộ (trừ phí giao dịch).
Sau khi duyệt sketch/thumbnail: Hoàn 100%.
Sau khi vẽ background phẳng + flat color: Hoàn 50%.
Sau khi vẽ detailed background hoặc chi tiết nhân vật chính: Hoàn 30%.
Sau tất cả các giai đoạn trên: Không hoàn tiền.9. Trách Nhiệm Pháp Lý
Tôi không chịu trách nhiệm cho bất kỳ việc lạm dụng tác phẩm nào của khách hàng.
Trách nhiệm của tôi giới hạn ở tổng số tiền bạn đã thanh toán.
Tôi không chịu trách nhiệm cho thiệt hại do chậm trễ hoặc thay đổi lịch trình.10. Giao Tiếp
Kênh liên lạc chính: Facebook, Zalo, Ins (vui lòng dùng một kênh chính).
Vui lòng giữ thái độ tôn trọng và kiên nhẫn. Tôi cũng sẽ làm như vậy.
Hành vi quấy rối, thô lỗ hoặc đòi hỏi quá mức sẽ dẫn đến hủy commission ngay lập tức không hoàn tiền.
